29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Maintenance/housekeeping: The written hazard communication program was inadequate. Employees use chemicals such as but not limited to flammable Rust-oleum spray paints, Crown paint thinner, gasoline, and various cleaning products. The following elements were missing from the program: 1. Current Safety Data Sheets (SDS's) to replace the former Material Safety Data Sheets; 2. A description of the new pictogram system; 3. A description of the labeling system that will be used in the workplace; 4. A list of hazardous chemicals used.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: Maintenance/housekeeping: Employees were not trained on the new label elements (e.g., pictograms and signal words) and the new SDS formation by December 2, 2013, as required by the revised Hazard Communication Standard. Employees handle and use hazardous chemicals such as, but not limited to, spray paints, gasoline, paint thinners, various oils, lubricants , and cleaning products.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2): Maintenance Shop/housekeeping: The employer has provided employees with personal protective equipment (PPE) such as ear muffs, ear plugs, gloves, and face shields to protect their hearing, eyes, and extremities from hazards such as flying particles, and noise, and skin irritation when weed whacking or performing housekeeping duties. The use of PPE is a job requirement. A hazard assessment has not been performed to include the following elements: 1. Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment; 2. Communicate the selection decisions to each affected employee and; 3. Select PPE that properly fits each affected employee.
