Smith & Young Roofing, LLC worksite located at 7 Queen Anne Way, Norwalk, Ohio: On or about May 17, 2017, the employer failed to ensure an accident prevention program was in place to aid the employer and his employees in the recognition and avoidance of hazards associated with residential roofing operations (i.e.; fall protection, and use of personal protective equipment).

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.      A. Smith & Young Roofing, LLC worksite located at 7 Queen Anne Way, Norwalk, Ohio: On or about May 17, 2017, the employer did not ensure employees were wearing proper eye protection while operating a pneumatic nail guns while installing weatherproofing.  The employees were exposed to potential flying object hazards while operating the pneumatic fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.       A. Smith & Young Roofing, LLC worksite located at 7 Queen Anne Way, Norwalk, Ohio: On or about May17, 2017, the employer did not ensure employees were protected from falls while installing weatherproofing on the two story residential structure. The employees were exposed to a fall distance of approximately 9.50 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.     A. Smith & Young Roofing, LLC worksite located at 7 Queen Anne Way, Norwalk, Ohio: On or about May 17, 2017, the employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations.
