29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices:    a) Bake Shop- On or about May 31, 2017, the employer did not ensure that employees performing unjamming and clearing of dough on the Winkler Roll Line Machines #1 and #2 understood the requirements for the safe application, usage and removal of the energy controls while accessing hazardous areas.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedure) was not done in sequence as required by 29 CFR 1910.147(d)(1) through (d)(6):    a) Bake Shop- On or about May 22, 2017, employees were exposed to machine hazards associated with moving parts and pinch points from the unexpected start-up and energization of Winkler #1 and Winkler #2 Roll Line machines when opening the guards that covered the chains and sprockets.  The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform unjamming and the clearing of dough [per the 1910.147(d)(2) requirements].  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)],  dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Maintenance Department- On or about May 25, 2017, the employer failed to ensure that hazards created by the unused portion of the saw blade were guarded on the metal cutting Wilton 3410 Horizontal Bandsaw were guarded to prevent injury to employees during operation.    b) Bake Shop- On May 22, 2017, the employer failed to ensure that hazards created by rotating parts, in-running nip points and pinch points on three separate areas of the B01-110 Proofer were guarded to prevent injury to employees during operation.  These areas were under the conveyor table where white drive gears were present, at the descending conveyor point where white drive gears made contact with the conveyor, and at the conveyor turn around in front of the descending conveyor.    c) Packaging Department- On May 22, 2017,  the employer failed to ensure that hazards created by rotating parts, pinch points, and points of operation on Box Machine #1 were adequately guarded.  The guards of the Box Machines were not securely affixed or provided with safety reliable interlocking devices to protect employees when performing unjamming and adjusting of the equipment.     d) Packaging Department- On May 22, 2017, the employer failed to ensure that hazards created by the point of operation on Box Machine #2 were adequately guarded.  The area where boxes were taped was not guarded to ensure employees were not exposed to the point of operation.     e) Packaging Department- On May 22, 2017, the employer failed to ensure that hazards created by pinch points on the Labeling Machines on Lines 3 and 4 were guarded.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:    a) Facility Wide- On May 22, 2017, the employer failed to conduct periodic inspections of each energy control procedure at least annually to verify the procedures were adequate and were being applied properly.  This would include an inspection of the machine specific procedures for equipment, such as the Winkler Roll Line Machine #1, Winkler Roll Line Machine #2, Box Machine #1, and the Box Machine #2.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
