29 CFR 1910.132(d)(1)(i): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment (PPE):  a) On or about May 31, 2017, in the Carpenter Shop, the employer did not assess the workplace to determine if hazards were present or likely to be present, which necessitates the use of personal protective equipment, including safety glasses, goggles, gloves, hearing protection, machine guarding, and material spreader.  Inmate employees were exposed to hazardous conditions, including amputations.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person which certified that the evaluation had been performed; the date(s) of the hazard assessment; and, which identified the document as a certification of hazard assessment.  a) On or about May 31, 2017, on the table saw in the Carpenter Shop, the employer did not perform a written hazard assessment and procedures to protect the inmate employees as required.  Inmate employees were exposed to amputations.

29 CFR 1910.213(c)(2):  Each hand-fed circular ripsaw shall be furnished with a spreader to prevent material from squeezing the saw or being thrown back on the operator. The spreader shall be made of hard tempered steel, or its equivalent, and shall be thinner than the saw kerf. It shall be of sufficient width to provide adequate stiffness or rigidity to resist any reasonable side thrust or blow tending to bend or throw it out of position. The spreader shall be attached so that it will remain in true alignment with the saw even when either the saw or table is tilted. The provision of a spreader in connection with grooving, dadoing, or rabbeting is not required. On the completion of such operations, the spreader shall be immediately replaced.  a) On or about May 31, 2017, in the Carpenter Shop, the employer did not ensure that the spreader for the hand-fed circular table-saw was attached so that it would remain in true alignment with the saw even when either the saw or table was tilted.  Inmate employees were exposed to amputations.
