29 CFR  1910.132(f)(1): The employer shall provide training to each employee who is required by this section to use PPE. Each such employee shall be trained to know at least the following: (i) When PPE is necessary; (ii) What PPE is necessary; (iii) How to properly don, doff, adjust, and wear PPE; (iv) The limitations of the PPE; and, (v) The proper care, maintenance, useful life and disposal of the PPE.  a) On or about May 4, 2022, employees working in the Carpentry Shop on the 4224 Powermatic Lathe had not been trained to wear impact resistant clear safety goggles when performing work such as chiseling, filing, grinding, chipping, and buffing.

29 CFR  1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.  Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locker-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.  a) On or about May 4, 2022 in the Carpentry Shop, lockout procedures were not developed, documented, and utilized for equipment such as but not limited to the 4224 Powermatic Lathe.

29 CFR  1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: (A):Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a) On or about May 4, 2022, the employer did not ensure that employees in the Carpentry Shop putting on and removing chucks and cleaning equipment such as but limited to the 4224 Powermatic Lathe were trained as authorized employees, trained on lockout procedures, and trained on the application of energy isolating devices.

29 CFR 1910.213(o)(4): Lathes used for turning long pieces of wood stock held only between the two centers shall be equipped with long curved guards extending over the tops of the lathes in order to prevent the work pieces from being thrown out of the machines if they should become loose.  a) On or about May 3, 2022 in the Carpentry Shop, the employer did not provide long curved guards during production when performing woodworking on 36-inch-long bats on the 4224 Powermatic Lathe.  b) On or about May 4, 2022 in the Carpentry Shop, the 12-inch guard that was present was inadequate in that there were 1-inch by 3-inch openings in the guard that allowed splinters of wood to be thrown out of the machine.

29 CFR  1910.213(r)(4): The mention of specific machines in paragraphs (a) thru (q) and this paragraph (r) of this section, inclusive, is not intended to exclude other woodworking machines from the requirement that suitable guards and exhaust hoods be provided to reduce to a minimum the hazard due to the point of operation of such machines.   a) On or about May 4, 2022, employer did not ensure that employees in carpentry shop  working on the 4224 Powermatic Lathe did not open the guard during production while the lathe was still running at  450 RPM to prevent employees from being struck by flying objects such as but not limit to the glued together pieces of a plaque.
