29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Avalon Child Care, Front side at entrance: On or about 05/26/2017 and at times prior, the employer exposed employees to struck-by hazards while using pneumatic framing nail guns, in that protective eyewear was not provided to an employee engaged in roof truss framing activities.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  (a) Avalon Child Care, Front side at entrance: On or about 05/26/2017 and at times prior, the employer allowed employees to work from a job-made scaffold platform exposing the worker to fall hazards, in that the platform resting on the forks of the GEHL RS6-34 Telescopic Handler was not designed to be used on this equipment. The manufacturer states that only approved work platform for elevating personnel can be used.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  (a) Avalon Child Care, Front entrance side: On or about 05/26/2017, and at times prior, the employer exposed employees to fall hazards of 18-feet, 4-inches while using a job-made work platform on a GEHL Telescopic Handler, in that the work platform was resting on the forks and not attached to the forks as employees used this platform to install roof trusses.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  (a) Avalon Child Care, Front entrance side: On or about 05/26/2017, and at times prior, the employer exposed employees to fall hazards of 18-feet, 4-inches to the lower level, in that a fall protection system was not provided to an employee working in a job made work platform.  K.L. Vick Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1188521, citation number 1, item number 1 and was affirmed as a final order on 04/23/2017, with respect to a workplace located at 306 Ardmore Circle, Atlanta, GA 30309.
