29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a guardrail system, safety net system, travel restraint system or personal fall arrest system. On or about 29 May 2017, an employee engaged in maintenance activities on the wing of a Scorpion was exposed to a fall hazard of approx. 8 feet from the wing of the aircraft to the ground below in that fall protection was not available and utilized.

29 CFR 1910.30(a)(3)(ii): Prior to any employee becoming exposed to a fall hazard, the employer did not ensure that all employees who use personal fall protection systems, or who is required to be trained, was adequately trained in the procedures to be followed to minimize those hazards. Employees engaged in wing work on an the Scorpion experimental aircraft in bldg. 31 were exposed to fall hazards of approx. 8' from the wing to the ground below in that employees were not adequately trained on the procedure to be followed to minimize fall hazards.
