29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    a) Worksite- 1400 Old Country Road, Westbury, NY, north side of building: Employee was working in close proximity to energized electrical power lines without PPE; on or about 6/14/17.    b) Worksite- 1400 Old Country Road, Westbury, NY, north side of building: Five employees were working directly below ongoing tree trimming and were not wearing head protection; on or about 6/14/17.       Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.332(b)(1): Employees were not trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertained to their respective job assignments:  a) Worksite- 1400 Old Country Road, Westbury, NY, north side of building: One employee was working in close proximity to energized 7,600 volt electrical power lines and was not trained to assess the hazards associated with doing ; on or about 6/14/17.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:    a) Worksite- 1400 Old Country Road, Westbury, NY, north side of building: Employees working alongside and directly below ongoing tree trimming were not wearing head protection; on or about 6/14/17.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
