29 CFR  1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:  a) Worksite- 126 Choir Lane, Westbury, NY, west side of residence: Employees working alongside and directly below ongoing tree cutting were not wearing head protection; on or about 12/7/ 20.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.  1. Branching Out Tree Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.135(a)(1), which was contained in OSHA inspection number 1240124, citation number 1, item number 2 and was affirmed as a final order on 1/8/18, with respect to a workplace located at 1400 Old Country Rd., Westbury, NY.  2. Branching Out Tree Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.135(a)(1), which was contained in OSHA inspection number 1304287, citation number 1, item number 1 and was affirmed as a final order on  12/13/18 , with respect to a workplace located at 125 Baker Hill Rd., Great Neck, NY.
