On or about June 15, 2017, at the job site, framing employees used the top two steps of a 10-foot aluminum step ladder to access the 11 feet and 6 inches high upper landing surface of the second floor, exposing the employees to an 11 feet fall hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. Framing employees working at elevations greater than 6 feet above the ground or lower levels while performing residential construction of wood frame houses are not being protected from fall hazards by a fall protection system. The employer fails to assure effective fall protection against falls as required by the standard as most recently demonstrated on June 15, 2017, at window openings and on the top plate of the outer walls of the second floor of the house under construction at 13657 NW 10th Place, Newberry Florida. Four framing employee where exposed to 12 feet and 21 feet falls to the ground below, in that they were not protected by a fall protection system. DWC Contracting, LLC. was previously cited for a violation of this Occupational Safety and Health Standard, 29 CRF 1926.501(b)(13), which was contained in OSHA inspection number 1117452, Repeat Serious citation number 01, item number 001, and was affirmed as a final order on May 17, 2016, with respect to a workplace located at Lot 196, SW 36th Drive, Gainesville, Florida. DWC Contracting, LLC. was previously cited for a violation of this Occupational Safety and Health Standard, 29 CRF 1926.501(b)(13), which was contained in OSHA inspection number 1004680, Repeat Serious citation number 02, item number 002, and was affirmed as a final order on February 5, 2015, with respect to a workplace located at 7827 SW 79th Drive, Gainesville, Florida. DWC Contracting, LLC. was previously cited for a violation of this Occupational Safety and Health Standard, 29 CRF 1926.501(b)(13), which was contained in OSHA inspection number 951010, Serious citation number 01, item number 003, and was affirmed as a final order on January 3, 2014, with respect to a workplace located at SW 80th Place, Gainesville, Florida. Framing employees accessing elevated work surfaces with portable ladders are not being provided ladders that extend at least three feet above upper landing surfaces in order to prevent fall hazards when climbing on and off these ladders. The employer fails to properly set up access ladders to upper landing surfaces as required by the standard as was most recently demonstrated on June 15, 2017, at a job site at 13657 NW 10th Place, Newberry, Florida where a 10-foot stepladder was used to access the 11 feet and 6 inches high upper landing surface of the second floor, exposing these employees to an 11 feet fall hazard.
