29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used. a) Jobsite: The employer did not provide a safe means of access from one level of the tubular supported welded frame scaffold to another by the use of portable ladders, hook-on ladders or other acceptable means. Employees climbed the scaffold supports to access the upper working levels. Noted on or about 6/29/17.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) Jobsite: The employer did not ensure that the employees performing bricklaying operations from a scaffold from the 5th level of the scaffold were protected by a fall protection system; thus exposing them to a fall hazard of approximately 35 feet. This condition was observed/noted on/about 29 JUN 2017.
