29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a) 78574-78700 Gallatin Road Bozeman, MT 59718: On June 29, 2017 and at times prior the employer signed and certified on the Daily Trenching Log that; utilities had been supported and protected, the soil classification was class "C" with wet soil conditions, that the trench would reach depths of approximately eight feet and two to four feet in width, excavated material was two feet from the edge of the excavation, ladders were within twenty five feet of the employees, and that trench shields, sloping and, benching would be the protective systems used. Employees were allowed to enter the excavation to install a new sewer line without any of these necessary precautions in place.
