29 CFR 1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) On or about September 9, 2021, in the vicinity of, Washington Avenue between West third Street and West fourth Street, Larimore, North Dakota . For the employee exposed to struck by hazards while installing the new sewer line directly beneath the spoil pile located on the edge of the excavation. Note: The JR Civil, LLC was previously cited for a serious violation of this Occupational Safety and Health Standard or its equivalent standard which was contained in OSHA Inspection Number 1243741, Citation 1, Item 3, and was affirmed as final order on November 21, 2017, with respect to a workplace located at 78574-78700 Gallatin Road, Bozeman, MT 59718.
