29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. a) East Center St and Fourth Ave East, Kalispell, MT: On or about May 5, 2023, and at times prior, employees were exposed to cave in hazards while installing main water lines in an unprotected 5 foot 9 inch deep trench with vertical walls. The employer failed to ensure that employees were removed from situations that could result in possible cave ins.
