29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: At the residential construction site located at 20899 W. 115th Street in Olathe, Kansas; Employees engaged in framing activities were exposed to dermal, and inhalation hazards from exposure to hazardous chemicals in that the employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work. Hazardous materials used at the site included but were not limited to Grip Rite Subfloor Construction Adhesive.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. Employees using the 16 ft. WERNER portable metal extension ladder in order to access the ceiling joists working area were exposed to fall hazards of approximately 10 feet from the edge of the wall of the house structure to the ground below in that the ladder did not extend at least 3 feet above the upper landing and was not secured to the residence.
