29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: On or about July 3, 2017, the employer failed to ensure that the platform, which was located directly over the continuous tempering washer machine, was protected on the side of the stairs exposing employees to the hazard of a fall from a height greater than 4 feet. The platform was approximately 6 feet high.

29 CFR 1910.147(c)(2)(ii): An energy isolating device that was capable of being locked out, did not utilize a lockout device, which renderedi the machine or equipment inoperative. On or about July 31, 2017, the employer did not ensure that employees were locking and tagging out machinery prior to them performing the task of clearing a jam. Machinery to include but not limited to the Continuous Tempering Washer.
