29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a) Webster Industries, Inc. on or about the dates of April 14-28, 2017, at the address of 325 Hall St. Tiffin, OH: The employer did not evaluate employees assigned work area for permit required confined spaces prior to tasking employees to perform work in such spaces. Employees were assigned to prepare the Continuous Flow Belt Furnace for a subcontracted refractory rebuild, requiring these employees to access the interior (confined space) of the furnace to assist in the removal of components and subsequently the installation of insulating material. By not effectively evaluating the workplace and informing affected employees of the location and potential hazards contained within, employees performing these assigned task(s) in the permit confined space were exposed to a potential hazardous atmosphere.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: a) Webster Industries, Inc. on or about the dates of April 14-28, 2017, at the address of 325 Hall St. Tiffin OH: The employer did not develop and implement a written permit space program prior to tasking employees to perform work in such spaces. 29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146: a) Webster Industries, Inc. on or about the dates of April 14-28, 2017, at the address of 325 Hall St. Tiffin, OH: The employer did not ensure that employees who are tasked with work activities in and around permit required confined spaces were adequately trained in the skills required prior to entrance. Employees tasked with work activities in the Continuous Flow Belt Furnace (confined space) were not specifically trained on hazard identification and avoidance relating to this type of confined space work.
