29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) On August 22, 2017, Soumar Masonry Restoration, Inc., did not provided with information and training with regard to the health and physical hazards of crystalline silica. Employees were exposed to crystalline silica dust during tuckpointing operations.

29 CFR 1926.103: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter. 29 CFR 1910.134(m)(2)(i)(C): The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee which included the specific make, model, style and size of respirator tested: (a) On August 22, 2017, Soumar Masonry Restoration, Inc. did not establish a record of qualitative or quantitative fit tests that included the information required by 29 CFR 1910.134(m)(2)(i)(A) through (m)(2)(i)(E). The fit test record(s) did not include the model/type/size of respirator tested.
