29 CFR 1926.503(c)(3):  "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where: Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.    Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part.    On August 23, 2017 at the 1066 Winneconne Av. Unit 8 Neenah, WI jobsite, employee(s) were not retrained when deficiencies were noted on the wearing of the full body harness.  Deficiencies included, but not limited to: having the D-ring located close to the tool belt and working without securing an anchor point.    Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard [29 CFR 1926.501(b)(13)], which was contained in OSHA inspection number 1046124, citation number 2, item number 1a and was affirmed as a final order on August 3, 2015, with respect to a workplace located at W6474 Strewblow Drive and Hwy 23, Fond Du Lac, Wisconsin.

29 CFR 1926.1053(b)(13): Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated: The top or top step of a stepladder shall not be used as a step.    On August 23, 2017 at the 1066 Winneconne Av. Unit 8 Neenah, WI jobsite, employees used a Featherlite step ladder to get on and off of the roof.  The employees lowered themselves onto to top of the step ladder to get off the roof being exposed to a fall hazard.      Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard [29 CFR 1926.1053(b)(13)], which was contained in OSHA inspection number 1059671, citation number 2, item number 1 and was affirmed as a final order on August 3, 2015, with respect to a workplace located at W6474 Moon Shadow Drive, Greenville, Wisconsin.    Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard [29 CFR 1926.1053(b)(13)], which was contained in OSHA inspection number 1046124, citation number 2, item number 1a and was affirmed as a final order on August 3, 2015, with respect to a workplace located at W6474 Strewblow Drive and Hwy 23, Fond Du Lac, Wisconsin.    Steve Fischer Construction LLC was previously cited for a violation of this occupational safety and health standard [29 CFR 1926.1053(b)(13)], which was contained in OSHA inspection number 761266, citation number 1, item number 1 and was affirmed as a final order on April 24, 2013, with respect to a workplace located at Glenpark Dr. and Bluemound, Appleton, Wisconsin.
