29 CFR 1910.1000(c): An employee(s) was exposed to silica, crystalline quartz (respirable fraction) in excess of the 8-hour time weighted average limit of 10 mg/m3 / % SiO2 + 2 listed in Table Z-3:  a)  In the shop, on or about December 13, 2017 - A Polisher was exposed to respirable dust containing 19% silica, crystalline quartz at a time weighted average exposure of 1.26 mg/m3 (milligrams per cubic meter of air). This level is 2.64 times the permissible exposure limit of 0.476 mg/m3 as a time weighted average concentration. Sampling was performed by an OSHA compliance officer on December 13, 2017 for 387 minutes and zero exposure was assumed for the unsampled portion of the shift.  b)  In the shop, on or about December 13, 2017 - A Fabricator was exposed to respirable dust containing 21% silica, respirable quartz, at a time weighted average exposure of 0.632 mg/m3 (milligrams per cubic meter of air). This level is 1.45 times the permissible exposure limit of 0.435 mg/m3 as a time weighted average concentration. Sampling was performed by an OSHA compliance officer on December 13, 2017 for 387 minutes and zero exposure was assumed for the unsampled portion of the shift.

Employees were exposed to silica, crystalline quartz (respirable fraction) above the permissible exposure limit.  (See description of employee exposures in Citation 1, Item 1a).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) At the establishment, on or about August 23, 2017 - The employer failed to address in their written hazard communication program who is responsible for obtaining and maintaining safety data sheets. Employees cut, saw, route, grind, and polish granite, marble and quartz counter tops creating respirable dust which contains silica, crystalline quartz. Exposure to respirable dust which contains silica, crystalline quartz is capable of causing silicosis.

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  a) At the establishment, on or about August 23, 2017 - The employer failed to maintain safety data sheets for granite, marble, and quartz counter top slabs. Employees cut, saw, route, grind, and polish granite, marble and quartz counter tops creating respirable dust which contains silica, crystalline quartz. Exposure to respirable dust which contains silica, crystalline quartz is capable of causing silicosis.
