29 CFR 1926.102(a)(1):  Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    At the residential construction site located at 4252 NE Tremont Ct, Lee's Summit, MO 64064:  Employees were exposed to a struck-by hazard.  Employees were exposed to injuries to the eyes and the face while using a Hitachi brand pneumatic nail gun without eye protection.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    At a residential construction site located at 4252 NE Tremont Ct, Lee's Summit MO: Employees were exposed to electrical shock hazards. The employer failed to protect employee from electrical shock in that equipment was being used without a ground pin.     a) On the second floor of the construction site a SKILSAW brand circular saw was connected to an extension cord and did not have a ground pin to ensure the path to ground was permanent, continuous and effective.    b) On the second floor of the construction site a SKILSAW brand circular (Serial # 689003225) saw was connected to an extension cord and did not have a ground pin to ensure the path to ground was permanent, continuous and effective.

29 CFR 1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:    At the jobsite located at 4252 Tremont Ct, Lee's Summit MO:  Employees engaged in residential framing activities were exposed to an electrical shock hazard.  The employer failed to protect employees from electrical shock hazards by allowing the use of flexible cords and cables with no strain relief.     a) Strain relief was not provided on the female plug end of the extension cord providing 120 V power to a SKILSAW brand circular saw on the second floor of the construction site.    b) Strain relief was not provided on the male plug end of the power cord providing 120 V power to a SKILSAW (Serial # 689003225) brand circular saw on the second floor of the construction site.    c) Strain relief was not provided on the female plug end of the extension cord providing 120 V power to a SKILSAW brand circular saw on the second floor of the construction site.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):     At the residential construction site located at 4252 NE Tremont Ct, Lee's Summit, MO 64064:  Employees were exposed to fall hazards. Employee were performing framing operations at an elevated height of 20.4 feet without any means of fall protection. Employees were observed crawling along the trusses and roof decking without having their fall protection attached to an anchor point.    Falke Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(b)(13), which was contained in OSHA inspection number 1082287, citation number 1, item number 1 and was affirmed as a final order on 08/25/2015, with respect to a workplace located at 16601 King Dr., Overland Park, KS 66062.
