29 CFR 1910.29(b)(1): (1) The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface.  The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11):     a) Inside the warehouse, on or about August 29, 2017 and at times prior to, the second floor areas and at the top of the stairs that provided access to the office and storage space had a thirty-six inch high top rail, exposing employees to a fall hazard.       b)  In the cooler department, above the service office, on or about October 11, 2017 and at times prior to, the mezzanine above the service office and at the top of the stairs that provided access to the office and storage space had a thirty-six inch high top rail, exposing employees to a fall hazard.

29 CFR 1910.37(b)(1): Each exit route was not adequately lighted so that an employee with normal vision can see along the exit route:    a) Throughout the facility, on or about October 11, 2017, emergency lighting was not operational to illuminate the exit routes inside the warehouse and fleet/maintenance shop areas, exposing employees to smoke inhalation hazards.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a)  At the facility, on or about and at times prior to August 30, 2017, the employer drilled a hole in the overhead protection pole attached to the Toyota SAS #1091,  #1553 and Crown #1618 forklifts without pre-approval from the forklift manufacturers. The employer drilled the holes in the pole to install a portable fire extinguisher, thus exposing employees to struck-by hazards.
