29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    a) Throughout facility: The employer did not ensure that employees provided 3M half face air purifying respirators model 6200 and Miller LPR 100 half face respirators for voluntary use were medically evaluated to determine their ability to use the respirators, on or about 9/26/17.    b) Throughout facility: The employer did not establish a written respiratory protection program for employees that voluntarily used 3M half face air purifying respirators model 6200 and Miller LPR 100 half face respirators, on or about 9/26/17.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.252(b)(2)(iii) Workers or other persons adjacent to the welding areas were not protected from the rays by noncombustible or flameproof screens or shields or were not required to wear appropriate goggles:    a) Welding area: Employees working adjacent to or passing the welding area were not protected from the welding arc rays by screens or appropriate goggles, on or about 10/3/17.    b) Plasma cutting area: Employees working adjacent to or passing the welding area were not protected from the plasma rays by screens or appropriate goggles, on or about 10/3/17.    c) Oxy torch cutting area: Employees working adjacent to or passing the welding area were not protected from the arc rays by screens or appropriate goggles, on or about 10/3/17.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a) Throughout facility: Employees using respirators voluntarily, including, 3M half face air purifying respirator model 6200, NS N95 model 7511 particulate filtering facepiece and Miller LPR-100 half face air purifying respirator, were not provided the information in Appendix D of the standard, on or about 9/26/17.  NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
