29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. On October 18, 2017, an employee working in the warehouse, was exposed to a noise dose of 85.02%, or an equivalent dBA (decibels A scale) of 88.83 dBA, which is capable of causing permanent hearing loss. The noise sampling was conducted for 438 minutes during one work shift. b. On October 18, 2017, an employee operating a cleaning machine in the warehouse, was exposed to a noise dose of 76.74%, or an equivalent dBA (decibels A scale) of 88.09 dBA, which is capable of causing permanent hearing loss. The noise sampling was conducted for 434 minutes during one work shift. The employer did not administer an effective hearing conservation program in that employees were not provided the required initial monitoring program, baseline or annual audiograms, and hearing protection training that included an explanation of audiometric testing, instructions on the fitting, use, and care of the various hearing protectors.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a. On or about October 17, 2017, at the cleaning machine area, an employee using the corrosive chemical, sodium hydroxide, did not have an eye wash station for the quick drenching or flushing of the eyes within the work area, for immediate emergency use.
