29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On October 26, 2017, located on the east side of a commercial roof structure, employees were installing shingles on a low pitch commercial roof as there were no frequent and regular inspections being performed by a competent person to ensure the job-site, materials and equipment such as residential fall protection systems and/or devices were being maintained and utilized in a safe condition. Potential fall height measured to be 10'-9". Roof pitch measured to be 4 in 12.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  On October 26, 2017 located on the east side of a commercial structure, employees were observed installing shingles on a low slope roof structure while not utilizing an adequate fall protection system. Potential Fall Heights were measured to be 10'-9" with a roof pitch of 4/12.  The Simon Trejo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1213666, citation number 1, item number 1 and was affirmed as a final order on 5/03/2017, with respect to a workplace located at 23 Pebble Rd., Pooler, GA 31322.
