On or about 10/30/17 located at 4460 Ivanhoe Walk, Cumming, GA: Employees were framing and installing the 2nd floor walls on the house that was under construction while working at the edges of the staircase floor hole opening, the employer did not ensure that guardrails or floor hole coverings was used by the employees while exposed to fall hazards of approximately up to 10.10- feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) On or about 10/30/17 located at 4460 Ivanhoe Walk, Cumming, GA: Employees were observed framing the 2nd floor walls a house that was under construction while working at the edge, the employer did not ensure that fall protection was used by the employees while exposed to fall hazards of approximately up to 11.4- feet. The employer has been made aware that the conditions violated a standard because the employer has been previously cited for violations of the same or similar fall protection standards. (1). Vinico Garduno Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926. 501 (b)(13), which was contained in OSHA inspection number 1117220, citation number 2, item number 1, and was opened on 1/12/2016, and the FOD date 4/14/15 with respect to a workplace located at 265 Meeting St., Marietta, GA 30060. Repeat (2).
