29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a  powered industrial truck.    On or about November 27, 2017, the employer did not provide adequate safety training to employees that were required to operator the powered industrial trucks to prevent stuck by hazards.    Abatement certification is required for this item in accordance with the requirement of 29 CFR 1903.19(c).

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance had not been conducted at least once every 3 years.  On or about November 27, 2017, the employer did not evaluate each powered industrial operator's performance at least every 3 years. Two employees operating the powered industrial vehicle last received their training and evaluation 4 and 7 years ago.  Abatement certification is required for this item in accordance with the requirement of 29 CFR 1903.19(c).

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):    On or about November 27, 2017, the employer did not repair or remove number 50 Caterpillar propane powered industrial truck serial number AT34A00353 from service due to broken propane strap which prevents or eliminate propane tank from fall off truck causing explosion and fire.    Abatement certification is required for this item in accordance with the requirement of 29 CFR 1903.19(c).
