29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    (a) On or about December 4, 2017 the employer did not assess the sanitation procedures to find that water pressurized up to 2,000 pounds per square inch is being used by employees every day to clean debris off of fryers 1, 2, and 3 located in the main processing area, exposing their face to a struck-by hazard in that they were provided safety glasses but no face shield.    (b) On or about December 4, 2017 the employer did not assess the sanitation procedures to find that once or twice per week employees using full strength liquid acids and caustics in open top 5 gallon buckets; were exposed to chemical splashes and a chemical burn hazard to their eyes and face in that they were only provided with safety glasses but no face shield.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:    (a) Employees performing sanitation to fryer number 1 in the main processing room using liquid acids and caustics are only provided safety glasses exposing their eyes and face to a chemical burn hazard.    (b) Employees performing sanitation to fryer number 2 in the main processing room using liquid acids and caustics are only provided safety glasses exposing their eyes and face to a chemical burn hazard.    (c) Employees performing sanitation to fryer number 3 in the main processing room using liquid acids and caustics are only provided safety glasses exposing their eyes and face to a chemical burn hazard.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:      (a) On or about December 4, 2017 at least 4 employees performing sanitation to fryers 1, 2, and 3 in the main processing room were required to use full strength liquid acids and caustics in open top buckets exposing them to a chemical splash hazard. There is only an eyewash and no shower located within the main processing area; furthermore the eyewash is plumbed into the sanitation boost pumps making it not suitable for use (too low of pressure) while sanitation work is being performed.        (b) On or about December 4, 2017 at least 4 employees performing sanitation work were required to gather liquid acid and caustic in open top 5 gallon buckets out of large tanks within the chemical room exposing them to a chemical splash hazard. There is only an eyewash and no shower located within the chemical room.

29 CFR 1910.305(a)(2)(x):  Flexible cords and cables were not protected from accidental damage, as might be caused, for example, by sharp corners, projections, and doorways or other pinch points:      (a) On or about February 2, 2018, a flexible cord powering one of the boost pumps was observed plugged into an outlet in the hallway and ran through a doorway located on the west wall of the main processing room towards the south corner exposing employees to an electrical shock hazard.

29 CFR 1910.334(a)(4): Portable electric equipment and flexible cords that was used in highly conductive work locations (such as those inundated with water or other conductive locations) or in job locations where employees were likely to contact water or conductive liquids were not approved for those locations:      (a) On or about February 2, 2018, a Landa Model: PHW4-22024A pressure washer was observed in the main processing area with multiple panels of the unit; to include the electrical panel, removed making it no longer sealed and therefore no longer approved for use in a highly conductive location. The pressure washer was being used during the sanitation process with puddles of water throughout the area exposing employees to an electrical shock hazard.
