29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a) The employer did not administer a hearing conservation program for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 dBA.  In the main processing room, a sanitation worker was exposed to noise levels at 75.16% of the permissible 8-hour TWA (90 dBA).  The equivalent dBA level of 75.16% is approximately 87.9 dBA.  Sampling was performed for 380 minutes during one shift.  Zero exposure was assumed for the unsampled period of 100 minutes.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) On or about October 27, 2017, in the main processing room, an employee who was initially assigned to perform sanitation work in September had not been provided information and training on hazardous chemicals including acid CIP, caustic CIP, and foaming cleaner that were used to clean fryers.
