29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) An employee who worked in the Chili's processing room during production operations, and then cleaned fryers in the main processing room during sanitation operations was exposed to an average noise level of 85.3 dBA during a 12.2-hour shift, which exceeded the reduced action level of 81.9 dBA for the extended work shift. (b) An employee who worked in the main processing room during production operations, and then cleaned a flour machine in the main processing room during sanitation operations was exposed to an average noise level of 86.5 dBA during a 12.85-hour shift, which exceeded the reduced action level of 81.6 dBA for the extended work shift. Quality Star Products, Ltd. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.95(c)(1), which was contained in OSHA inspection number 1280906, citation number 1, item number 1 and was affirmed as a final order on March 9, 2018, with respect to a workplace located at 3930 Miller Park Drive, Garland, Texas 75042.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) In the main processing room, an employee performing sanitation operations wore a half-mask elastomeric facepiece respirator voluntarily and the employee had not been medically evaluated to determine fitness for respirator wear.
