29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about December 2, 2017, at the site located at 712 Eagle Walk Road, Delaware, Ohio, employees were performing framing work on a two story residential home while working on the second story floor level at approximately 10 feet in height from the ground with no fall protection, thereby exposing the employees to a fall hazard. b. On or about December 2, 2017, at the site located at 712 Eagle Walk Road, Delaware, Ohio, employees were performing framing work on a two story residential home while working on the second story floor level that had an approximately seven foot by seven and a half foot opening in the floor for a stairway to be installed approximately twenty one foot in height from the basement floor that was not adequately protected, thereby exposing the employees to a fall hazard.
