The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. On or about November 5, 2019 on the job site located at 12519 Preservation Way, Pickerington, OH 43147, the employer did not ensure that employees had been adequately trained on recognizing fall hazards, selecting acceptable fall protection systems, inspection and the safe use of fall protection systems and the fall protection standards contained 1926 Subpart M.

29 CFR 1926.1060(a)(1): The employer shall ensure that each employee has been trained by a competent person in:   29 CFR 1926.1060(a)(1)(iii): The proper construction, use, placement, and care in handling of all stairways and ladders;  a. On or about November 5, 2019 on the job site located at 12519 Preservation Way, Pickerington, OH 43147, employees were exposed to a fall hazard while using a portable A-frame step ladder to access the second story of the residential structure. The employees were not trained on the proper use and placement of all ladders in use on-site.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   The employer does not protect each employee from the hazard of falling by the use of fall protection systems.    This most recently occurred on November 5, 2019 on the job site located at 12519 Preservation Way, Pickerington, Ohio 43147. The employer failed to ensure that two employees who were performing framing work from the second floor of a new build residential home were protected from fall hazards while sheathing the second floor, thereby exposing them to an approximately twenty foot fall hazard.    Alejandro Vazquez Gallegos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1397321, citation number 2, item number 1 and was affirmed as a final order on August 20, 2019, with respect to a workplace located at Lot 73, 2635 Clemton Park West, Blacklick, Ohio.    Alejandro Vazquez Gallegos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1324337, citation number 2, item number 1 and was affirmed as a final order on July 24, 2018, with respect to a workplace located at 4351 McAlister Park Drive, Westerville, Ohio.    Alejandro Vazquez Gallegos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1280829, citation number 1, item number 1 and was affirmed as a final order on March 28, 2018, with respect to a workplace located at 712 Eagle Walk Road, Delaware, Ohio.    Alex Vasquez Gallegos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1260271, citation number 1, item number 1 and was affirmed as a final order on December 12, 2017, with respect to a workplace located at 435 Fawn Road, Delaware, Ohio. 29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    The employer does not ensure an effective safety and health program was in place to protect employees from hazards while performing framing work.    This most recently occurred on November 5, 2019 on the jobsite located at 12519 Preservation Way, Pickerington, Ohio 43147. The employer did not maintain a safety and health program to ensure hazards were identified and corrected onsite while performing framing work.  Hazards included, but were not limited to, fall hazards of up to 20 feet, fall protection use and requirements, unsafe use of ladders, no training on ladders.     Alejandro Vazquez Gallegos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1397321, citation number 1, item number 1 and was affirmed as a final order on August 20, 2019, with respect to a workplace located at Lot 73, 2635 Clemton Park West, Blacklick, Ohio. 29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   The employer does not ensure that portable ladders are selected and used to provide a safe means of access to upper landings.     This most recently occurred on November 5, 2019 on the jobsite located at 12519 Preservation Way, Pickerington, OH 43147. The employer did not ensure that employees using a portable A-frame ladder to access the second story of the residential structure were provided with a ladder that extended at least three-feet above the second level landing surface of the residential structure.      Alejandro Vazquez Gallegos was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1324337, citation number 1, item number 1 and was affirmed as a final order on July 24, 2018, with respect to a workplace located at 4351 McAlister Park Drive, Westerville, Ohio.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
