29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program: On October 3, 2018, an employee working at the Bag Blow-off station of Line 7 was exposed to noise at an 8-hour dose of 235.9% which is an 8-hour TWA noise level equivalent of 96.2 dBA at the 80 dB threshold. The employer was made aware of the personal exposure level on or about October 30, 2017. On or about December 5, 2017, the employer had not developed or implemented a monitoring program to determine noise exposure levels for employees working on Line 7.

29 CFR 1910.95(d)(1)(i): The sampling strategy shall be designed to identify employees for inclusion in the hearing conservation program and to enable the proper selection of hearing protectors: On October 3, 2018, noise sampling conducted on Line 7 was not designed to identify employees for inclusion in a hearing conservation program or to enable the proper selection of hearing protectors. Sampling was conducted with one noise dosimeter (on a crew of typically seven to eight employees) on an employee who was directed by the employer to remain at the Bag Blow-off station for the full-shift instead of following the typical work station rotation schedule.

29 CFR 1910.95(d)(1)(ii): Where circumstances such as high worker mobility, significant variations in sound level, or a significant component of impulse noise make area monitoring generally inappropriate, the employer shall use representative personal sampling to comply with the monitoring requirements of this paragraph unless the employer can show that area sampling produces equivalent results: On October 3, 2018, where circumstances, including but not limited to, high worker mobility made area monitoring generally inappropriate, the employer did not collect representative personal sampling to comply with the monitoring requirements of this paragraph. Line 7 consisted of a crew of typically seven to eight employees who rotated through work stations on a daily basis. The noise sampling collected at the Bag Blow-off station of Line 7 was not representative and did not account for worker's mobility through the work stations of Line 7.

29 CFR 1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling: On or about December 11, 2017, a metallic outlet box (handy box), located on the floor between the bag sealers and Bag Blow-off station conveyor in the northeast corner of the bag filling area of Line 7, was not installed in accordance with the UL identifier QCIT which states that boxes shall be mounted in or on a surface. The handy box was connected to a flexible cord and used as an extension cord to power the bag sealer and scale.
