29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees:    (a) Oliver Plate Saw - On or about December 4, 2017, the employer did not ensure an employee sweeping chips from the chip conveyor was trained and certified as an "Authorized" employee. The employee received an amputation injury to the ring finger on the right hand when the machine completed it's operational cycle and the worker's finger was caught between the chip chute and clamp. The employee performed this servicing/maintenance activity without the knowledge and skills needed for the safe application, usage, and removal of the energy controls.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):     (a) Production area - On or about December 4, 2017, employees were exposed to caught-in between hazards associated with moving machine parts  while performing end of the day cleanup operations, i.e., sweeping chips from the chip conveyor, on an Oliver 8792 Plate Saw while the saw was in operation.  The employer failed to implement energy control application steps as the press was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements].  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i), and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:    (a) The employer failed to ensure that all the employees in the facility that operate both the forklift and the side loaders were properly evaluated every three years. During the period of December 4, 2017, to May 21, 2108, the Warehouse Manager operated the powered industrial trucks without current evaluations, the last documented evaluation was April 24, 2014.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  (a) The employer's documented hazardous energy control procedures did not outline the scope and purpose of the procedure(s), the magnitude(s) of energy to be encountered and the means to enforce compliance with the procedure(s). On or about May 4, 2018, the operator of the Oliver Plate Saw locked and tagged out the saw to clean out the chips at the end of the work day utilizing the deficient procedure.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
