29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a) At Lot 186 Stone Park Blvd., Pike Road, Alabama:  On or about December 28, 2017 and at times prior; the employer allowed his employees to use the top step of an a-frame ladder to gain access to the second floor of the home exposing his employees to a fall hazard of 8 feet to the concrete floor below.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:     a) At Lot 186 Stone Park Blvd., Pike Road, Alabama:  On or about December 28, 2017 and at times prior; the employer allowed his employees to use an a-frame ladder to gain access to the second floor of the home which had a broken leg exposing his employees to a fall hazard of 8 feet to the concrete floor below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      a) At Lot 186 Stone Park Blvd., Pike Road, Alabama:  On or about December 28, 2017 and at times prior; the employer allowed his employees to perform framing activities from the third floor level without fall protection exposing his employees to a fall hazard of 21 feet to the concrete floor below.  b) At Lot 186 Stone Park Blvd., Pike Road, Alabama:  On or about December 28, 2017 and at times prior; the employer allowed his employees to perform framing activities from the second floor level without fall protection exposing his employees to a fall hazard of 10 feet 6 inches to the concrete floor below.  c) At Lot 186 Stone Park Blvd., Pike Road, Alabama:  On or about December 28, 2017 and at times prior; the employer allowed his employees to perform framing activities from the second floor trusses without fall protection exposing his employees to a fall hazard of 10 feet 6 inches to the concrete floor below.   THE DIAZ PROFESSIONAL CONSTRUCTION, LLC  WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501 (B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1165778 CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 25, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 10353 DUNCANNON TRAIL, MONTGOMERY, ALABAMA, AND CONTAINED IN OSHA INSPECTION NUMBER 176811 CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 13, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9366 TURNBERRY PARK DR., MONTGOMERY,  ALABAMA  AND CONTAINED IN OSHA INSPECTION NUMBER 1275479 CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 21, 2017, WITH RESPECT TO A WORKPLACE LOCATED AT 10344 DUNCANNON TRAIL, MONTGOMERY,  ALABAMA.
