29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet or more above lower levels are not protected by guardrail systems, safety net systems, or personal fall arrest systems, or an alternative fall protection plan which meets the requirements of 1926.502(k): a) The employer fails to ensure effective protection against falls as required by the standard, as demonstrated on or about August 8, 2018, at 1835 Mabel Drive, Prattville, Alabama, when employees performing framing activities from the top of framed walls, without the use of conventional fall protection, are exposed to a fall hazard of 9.1 feet to the concrete floor below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At 1835 Mabel Drive, Prattville, Alabama: On or about August 8, 2018, and at times prior; the employer failed to ensure an extension ladder used by employees to gain access to the top of the framed walls had its rails extended at least three feet above the landing to provide safe access exposing his employees to a fall hazard of 8.7 feet to the concrete floor below. THE DIAZ PROFESSIONAL CONSTRUCTION, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.1053 (B)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1176811 CITATION NUMBER 1, ITEM NUMBER 4, AND WAS AFFIRMED AS A FINAL ORDER ON OCTOBER 13, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9366 TURNBERRY PARK DRIVE, MONTGOMERY, ALABAMA
