29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. On or about February 8, 2018, an employee was not certified or trained by the employer to operate a power industrial fork truck, exposing employees to the hazards associated with fork truck operations. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered: On or about February 8, 2018, the operator and a second employee were using the elevated forks of an power industrial tuck as a work bench, exposing the employees to a struck-by hazard. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
