29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a.  On or about February 08, 2018 employees acting in the capacity of machine operator were exposed to noise hazards where the employer did not develop and implement a hearing conservation program.   On February 08, 2018 two machine operators were monitored for 470 minutes resulting in time weighted average exposures of 91.4 dBA and 91.9 dBA or equivalently doses of 121.8 % and 130.6% respectively for the 80 dBA threshold.    b. On or about February 08, 2018 employees acting in the capacity of packer were exposed to noise hazards where the employer did not develop and implement a hearing conservation program.  On February 08, 2018 a packer was monitored for 472 minutes resulting in a time weighted average exposure of 90.7 dBA or equivalently a dose of 110.7% for the 80 dBA threshold.    c. On or about February 08, 2018 employees acting in the capacity of inspector were exposed to noise hazards where the employer did not develop and implement a hearing conservation program.  On February 08, 2018 an inspector was monitored for 473 minutes resulting in a time weighted average exposure of 89.3 dBA or equivalently a dose of 92.02% for the 80 dBA threshold.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
