29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.    On February 14, 2018, located on west side of a residential exterior structure, the employer had not adequately ensured that a competent person properly inspected the telescopic handler rough terrain forklift with a work platform basket attachment to ensure that the work platform basket met the fall protection requirements, was properly secured to the forklift while raising the work platform basket and moving the forklift with the employee in the work platform basket into position to install windows.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    On February 14, 2018, located on west side of a residential exterior structure, an employee was exposed to a 16 ft. fall hazard standing inside an open front of a work platform basket that was inadequately attached to the forks of a telescopic handler rough terrain forklift being raised to install windows while not utilizing any fall protection system.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.    On February 14, 2018, located on west side of a residential exterior structure, an employee was exposed to a fall hazard as their was no guardrail system installed on the front side of the work platform basket that was attached to the forks of a telescopic handler rough terrain forklift. Potential fall height measured to be 16 feet.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

On February 14, 2018, located on west side of a residential exterior structure, an employee was observed working from inside a work platform that was elevated and that the work platform had not been firmly secured to the lifting carriage or forks of a the telescopic handler rough terrain forklift . Potential fall height measured to be 16 feet.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
