29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On March 15, 2018, there were no frequent and regular inspections being performed by a competent person in that:  (a) employees were using an 8 foot stepladder, positioned on the first floor area inside the building structure, to gain access to the upper structure by standing on the top step and lifting themselves up to the second story floor area (which was 12 feet above the first floor area)    (b) employees were using an 8 foot stepladder as the only means of transitioning to and from the second story floor area (which was 12 feet above the first floor area)   (c) employees were leaning an 8 foot stepladder in the closed position against an exterior wall to install building wrap material     (d) employees were using a pneumatic nail gun without eye protection     (e) employees were working on a second story floor area at fall heights greater than 24 feet and 13 feet above the ground below without being tied off to an anchorage

29 CFR 1926.502(d)(11): Lifelines shall be protected against being cut or abraded.  On March 15, 2019, located at a commercial structure, employees were utilizing knots in a rope lifeline around structural beams as anchorages without providing for lifeline protection (to prevent scuffing or abrasion due to friction). Potential fall heights were determined to be greater than 24 feet (south side) and 13 feet (southwest side) above the ground below.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  On March 15, 2019, located at a commercial structure, employees were using knots in a rope lifeline tied around structural beams as anchorages, adversely affecting the minimum breaking strength of 5,000 pounds. Potential fall heights were determined to be greater than 24 feet (south side) and 13 feet (southwest side) above the ground below.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer did not provide an effective training program for employees performing work from a commercial second story floor area while not utilizing a fall protection system and exposed to fall heights greater than 24 feet (south side) and 13 feet (southwest side) above the ground below.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.  On March 15, 2019, located at a commercial structure, employees were using an 8 foot stepladder to gain access to and from a second story floor area located 12 feet above the next lower level, resulting in a break in elevation of 48 inches. Potential fall heights were determined to be greater than 12 feet above the ground below.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On March 15, 2019, located on the south and southwest sides of a commercial structure, employees were performing framing work at the unprotected edges of a second story floor area while not utilizing a fall protection system. Potential fall heights were determined to be greater than 24 feet (south side) and 13 feet (southwest side) above the ground below.   Harry Hernandez was previously cited for a violation of this occupational safety and health standard or its substantially similar standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1294956, citation number 1, item number 2 and was affirmed as a final order on 5/15/2018, with respect to a workplace located at 1740 Eden Park Dr., Hamilton OH 45013.
