29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On February 27, 2018, located throughout a residential roof, the employer failed to install a fall protection system prior to employees removing shingles from a low pitch residential roof structure. Potential fall height was measured to be 8'-8" with a roof pitch of 4/12. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On February 27, 2018, located throughout a residential roof, employees were observed standing on a low pitch roof removing shingles while not utilizing any fall protection system. Potential fall height measured to be 8'-8" with a roof pitch of 4/12. The Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1078571, citation number 1, item number 1 and was affirmed as a final order on 10/05/2015, with respect to a workplace located at 11036 Embassy Dr., Cincinnati, OH 45240. The Hernandez Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1058419 , citation number 2, item number 1 and was affirmed as a final order on 07/20/2015, with respect to a workplace located at 4834 Prosperity Pl, Cincinnati, OH 45238
