29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  On July 1, 2020, located on the west side of a residential roof structure, an employee exposed to a fall hazard while accessing a ladder jack scaffold platform more than 2 feet in that the employer failed to install a safe means of access such as a portable ladder to gain access to the scaffolding platform.  The potential fall height measured to be 17 feet.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.   On July 1, 2020, located on the west side of a residential structure, an employee exposed to a fall hazard installing shingles onto a steep pitch roof while working from a ladder jack scaffold as there were no supervision and direction performed by a competent person to ensure ladders, personal fall arrest systems were installed and utilized safe manner. The potential fall height measured to be 17 feet. The roof pitch measured to be 16/12.

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold shall be protected by a personal fall arrest system;   On July 1, 2020, located on the west side of a residential roof structure, an employee exposed to a fall hazard installing shingles onto a steep pitch roof while working from a ladder jack scaffold in that the employee was not protected from a fall hazard by the use of a personal fall arrest system.  The potential fall height measured to be 17 feet. The roof pitch measured to be 16/12.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  On July 1, 2020, located throughout a residential roof, employees were exposed to a fall hazard installing shingles onto a steep pitch roof while not utilizing any fall protection system. The potential fall height is measured to be 13 feet with a roof pitch of 6/12 & 16/12.   The Hernandez Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1297758, citation number 2, item number 1 and was affirmed as a final order on 6/19/2018, with respect to a workplace located at 9040 Debbie Dr., West Chester, OH 45069.  The Hernandez Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1078571, citation number 1, item number 1 and was affirmed as a final order on 10/05/2015, with respect to a workplace located at 11036 Embassy Dr., Cincinnati, OH 45240.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  On July 1, 2020, located throughout a residential roof, the employer failed to install a fall protection system prior to employees installing shingles onto a steep pitch residential roof structure. The potential fall height is measured to be 13 feet with a roof pitch of 6/12 & 16/12.  The Hernandez Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR1926.502(a)(2), which was contained in OSHA inspection number 1297758, citation number 1, item number 1 and was affirmed as a final order on 6/19/2018, with respect to a workplace located at 9040 Debbie Dr., West Chester, OH 45069.
