29 CFR 1910.29(b)(10): The employer did not ensure when guardrail systems used at hoist areas, a removable guardrail section, consisting of a top rail and midrail, are placed across the access opening between guardrail sections when employees are not performing hoisting operations. The employer may use chains or gates instead of a removable guardrail section at hoist areas if the employer demonstrates the chains or gates provide a level of safety equivalent to guardrails. (a) Employees were exposed to 9'4" fall from the storage area above, exposing them to serious injuries. The guardrail system consisted of only a top rail chain that was sagging down to a 24" height from the platform. The chain was hanging on one nail at each end.

The Spirit Mountain Casino was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.305(g)(1)(iv)(B), which was contained in OSHA inspection number 917581, citation number 1, item number 1 and was affirmed as a final order on 7/25/2013, with respect to a workplace located at Grande Ronde, OR 97347.
