OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and or fall hazards in that the sixteen foot long work platform was being held aloft by a rough terrain forklift from the end of the platform:    Among other methods, some feasible and acceptable abatement methods to correct this hazard may include, but are not limited to the following:    1. Develop, implement and enforce procedures that ensure that the lift completely engages the load. Fork length should be at least two-thirds of the load length as indicated in Paragraph 6.4.5 of ANSI/ITSDF B56.6-2005 (Safety Standard for Rough Terrain Forklift Trucks).

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    On the southwest corner of the building the employer did not ensure that employees working from the work platform being held aloft by the rough terrain forklift were protected from falls. Employees were exposed to fall hazards of up to approximately thirty five (35) feet to the ground below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.     The employer did not ensure that employees working on the north west and the south west corners of the building being constructed were protected from falls. Employees were exposed to fall hazards of up to approximately thirty five (35) feet to the ground below.
