OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an in-going nip point on a trim line conveyor:    (a)New Angus, LLC dba DemKota Ranch Beef at 13 135th Street South West, Aberdeen, SD 57401:  On or about and at times prior to April 4, 2018, the employer did not ensure that employees were protected from the ingoing nip point related to a conveyor on the trim line. The conveyer belt was sagging approximately five inches which exposed an in-going nip point where the belt met the pulley of the conveyor which was in close proximity where employees work. This condition exposed employees to the hazard of caught-in by the conveyer roller.    Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow American Society of Mechanical Engineers ASME B20.1-2012 Safety Standard for Conveyors and Related Equipment, paragraph 6.1 Belt Conveyors: Fixed in Place, 6.1.1 Safety Considerations (a) Nip point and shear points shall be guarded.

This condition exposed employees to a fall hazard greater than four feet.    (c)New Angus, LLC dba DemKota Ranch Beef at 13 135th Street South West, Aberdeen, SD 57401: On or about and at times prior to April 4, 2018, the employer did not ensure that employees were protected from fall hazards associated with the upper maintenance cat walk in the barn area due to missing guardrails near a mechanical drive. Employees accessed the cat walk to perform preventative maintenance. This condition exposed employees to a fall hazard greater than four feet.    (d)New Angus, LLC dba DemKota Ranch Beef at 13 135th Street South West, Aberdeen, SD 57401: On or about and at times prior to April 4, 2018, the employer did not ensure that employees were protected from fall hazards associated with an open manure pit located in the barn area due to maintenance activities. Employees had to work within in close proximity to the open pit while changing out a sump motor.This condition exposed employees to a fall hazard greater than four feet.

Abatement Note:  A sign reading "DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER" or using other similar language would satisfy the requirement for a sign.

The eye wash was not functioning properly in that, the eyewash was unable to provide at least 1.5 liters (.04 gallons) of clean water per minute due to restricted flow and also missing the handle to utilize the quick drenching function of the overhead body wash. The eye wash station was also blocked and restricted access for employees in the area. This condition exposed the employees to the risk of permanent damage to the eyes.    New Angus, LLC dba DemKota Ranch Beef was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.151(c) which was contained in OSHA inspection number 1183166, citation number 1, item number 1 and was affirmed as a final order on January 20, 2017, with respect to a workplace located at 13 135th Street South West, Aberdeen, SD 57401.
