29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support): (a) New residential structure located on Lot #203, Front side: On or about 04/05/2018, and at times prior, the employer exposed employees to falls of up to 13-feet to the lower level, in that the ladder used to access the roof was not set at the proper angle. A safe angle of 75-1/2 degrees is recommended by the manufacturer and the ladder on site was placed at a 50-degree angle.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located on Lot #203, Roof: On or about 04/05/2018, and at times prior, the employer exposed employees to fall hazards of 9-feet, 3-inches to 30-feet to the lower ground level, in that a fall protection system was not provided to employees using a steep roof as a walking/working surface to perform house wrap activities. Fenix General Solution, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1207609, citation number 1, item number 1 and was affirmed as a final order on 03/13/2017, with respect to a workplace located at 325 Harvest View Terrace, Woodstock, GA 30188.
