29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 1105-1106 Chopin Drive, Bayberry South, Middletown, DE - On or about April 5, 2017 the employer failed to ensure employees engaged in framing of a residence approximately 13 feet above grade were protected from a fall hazard.  b) Lot on Cagney Lane, Bayberry South, Middletown, DE - On or about April 5, 2017 the subcontractor failed to ensure employees engaged in framing of a residence approximately 13 feet above grade were protected from a fall hazard  c) Lot 100 Chopin Drive, Bayberry South, Middletown, DE - On or about April 13, 2017 the employer failed to ensure employees engaged in framing of a residence approximately 16 feet above grade were protected from a fall hazard.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) 1105-1106 Chopin Drive, Bayberry South, Middletown, DE - On or about April 5, 2017 the employer failed to ensure employees exposed to a fall hazard of approximately 13 feet above grade had fall protection training.  b) Cagney Lane, Bayberry South, Middletown, DE - On or about April 5, 2017 the employer failed to ensure employees exposed to a fall hazard of approximately 13 feet above grade had fall protection training.  c) Lot 100 Chopin Drive, Bayberry South, Middletown, DE - On or about April 13, 2017 the employer failed to provide fall protection training to employees exposed to a fall hazard of approximately 16 feet above grade.  Brutus Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 503(a)(1), which was contained in OSHA inspection number 1295811, citation number 1, item number 4b and was affirmed as a final order on March 23, 2018, with respect to a workplace located a 2200 Wakeling St, Philadelphia, PA.
