29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. There were no frequent and regular inspections being performed by a competent person, on or about the 11-day period of April 16 - 30, 2018, in that heavy construction equipment was not being maintained and utilized in a safe condition in that the John Deere Excavator 245G had a missing/broken rear mirror.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On April 30, 2018, located inside a construction work zone, an employee directing a materials truck was injured by a John Deere Excavator 245G moving in a reverse direction, in that employees had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work.

29 CFR 1926.601(b)(5): All vehicles with cabs shall be equipped with windshields and powered wipers. Cracked and broken glass shall be replaced. Vehicles operating in areas or under conditions that cause fogging or frosting of the windshields shall be equipped with operable defogging or defrosting devices. On or about the 11-day period of April 16-30, 2018, located inside a construction work zone, the employer did not ensure that construction motor vehicle(s) with defects or in any way unsafe were taken out of service until restored to safe operating condition. Employees were found to have operated a John Deere Excavator 245G that was in need of repair due to a missing/broken mirror.
