A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. Located at or adjacent to the intersection of Middleton Ave. and McAlpin Ave. Cincinnati, OH employees were observed working within an excavation in excess of 8 feet deep in which there was no ladder or other safe means of exit egress located within 25 feet of employees lateral travel.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) Design of sloping and benching systems or (c) Design of support systems, shield systems, and other protective systems. Located at or adjacent to the intersection of Middleton Ave. and McAlpin Ave. Cincinnati, OH employees were observed working within an excavation in excess of 8 feet deep who were not protected from cave-in hazards in that the side walls of the excavation were not adequately sloped, shored or otherwise protected against collapse.

29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures. Located at or adjacent to the intersection of Middleton Ave. and McAlpin Ave. Cincinnati, OH employees were observed working within an excavation in excess of 8 feet deep in which there was a 24 inch x 34 inch section of unsupported undermined sidewalk projecting over the inside edge of a concrete inlet above an employee who was working within the inlet without other methods of protection in place under the sidewalk to protect the employee from collapse of the sidewalk structure.
