29 CFR 1926.501(b)(7)(ii):Each employee at the edge of a well, pit, shaft, and similar excavation 6 feet (1.8 m) or more in depth shall be protected from falling by guardrail systems, fences, barricades, or covers. a) On or about May 14 2025, the employer failed to ensure that guardrail systems, fences, barricades, or covers were installed around the open side of a 20-foot-deep trench adjacent to SR 128. As a result, employees working at ground level near the excavation were exposed to a 20-foot fall hazard.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired. a.)On or about May 14 2025, the employer failed to withdraw from service or tag as "Do Not Use" a portable ladder that had broken and missing rungs, which employees used to enter and exit a 20-foot-deep trench. As a result, employees were exposed to a 20-foot fall hazard while climbing in and out of the excavation.
